I advise insurers, and their clients, on professional negligence related construction claims. The insureds I regularly deal with include architects, engineers, design and build contractors, surveyors and many more construction professionals. My work includes advising insurers on policy coverage and helping their insureds to avoid and settle disputes. This routinely includes adjudications, mediations and litigation (generally in the TCC).
A recent highlight was settling a large claim involving problems in the design of two residential apartment blocks. We worked together as a team (which included our experts, the insured and ourselves) to identify the issues quickly. We were then able to advise accurately on the insured’s exposure to the claim and manage its expectations. This enabled us to negotiate an early and extremely beneficial settlement. The claim itself would have involved several parties across two jurisdictions. We therefore avoided embroiling insurers and the insured in expensive and time consuming litigation. We also achieved a great result for our clients.
