I specialise in acting for insurers in relation to financial institutions and D&O claims, providing coverage advice and monitoring the claims on behalf of insurers. I have also acted in the defence of professional negligence claims against financial professionals, both in court proceedings and in mediation, including in the successful appeal of a preliminary issue to the Privy Council relating to a claim brought by the beneficiaries of a Guernsey trust against a Guernsey trustee (Spread Trustee Company Limited v Sarah Ann Hutcheson & Others [2011] UKPC 13).
I have experience of contingency insurance, having defended a leading insurer in a coverage dispute in the High Court relating to a prize indemnity policy. I have also advised on contingency policy wordings.
In addition to the above, I have acted in Bermuda Form product liability disputes and reinsurance disputes, in which I have obtained experience of both LCIA and ad hoc arbitration proceedings.
A highlight for me was defending the leading insurer in the contingency insurance coverage proceedings referred to above. We worked closely with the client to agree the strategy and defended the claim robustly. This resulted in a favourable settlement being reached shortly before trial.
Another highlight was acting in the appeal heard by the Privy Council referred to above. This underlying dispute had been long running. It was only following our success at the Privy Council that the underlying dispute became capable of settlement, something with which our clients were obviously pleased.
